RAMPART NEWS SUBSCRIPTION TERMS
Rampart News Pty Ltd (ABN 94 682 901 042) (Rampart, we, us, or our) operates a subscription news service that allows subscribers to access news articles and content (Rampart News Content) via the website www.rampart.news (Website).
These terms, together with the Website terms of use located here: https://www.rampart.news/terms-of-use/, govern your subscription, and your use of, and access to, our services, including access to the Website and Rampart News Content (Services). By becoming a subscriber, you agree to these terms and agree to comply with them. If you do not agree to these terms, you must not use or access our Services.
We reserve the right to amend these terms from time to time and will notify you of any material changes. Please ensure that you check these terms every time you wish to use or access our Services so that you are aware of the current terms that apply at that time.
- REGISTRATION
- In order to subscribe, you must be at least 18 years of age (or otherwise have the consent of your parent or guardian) and register for and create an account on the Website (Account).
- To create an Account, you will be required to provide us with personal information such as your name and email address, phone number, residential address, occupation, and submit details of a valid and accepted method of payment (such as a credit/debit card) (Payment Method).
- In addition, in order to proceed with a group or corporate subscription, you will also be required to provide us with personal information of those users (such as their name and email address to be included in your subscription (each, a Nominated User). You agree that you have permission from those Nominated Users to provide their personal information to us.
- Any personal information that you provide to us will be handled in accordance with our privacy policy located here: https://www.rampart.news/privacy-policy/.
- By creating an Account, you agree:
- to keep your Account, including your username, password and other credentials, confidential and to not share these details with any third party;
- that all information provided in relation to your Account will be complete, valid, accurate and up-to-date;
- that you will be responsible for any activities engaged in using your Account, except to the extent that your Account is accessed by an unauthorised party due to an act or omission by Rampart; and
- that we may disable or suspend your Account if you are in material breach of these terms.
- YOUR SUBSCRIPTION
- Your subscription provides you with digital access to Rampart News Content via the Website in accordance with your selected subscription plan (Subscription Plan) while you have an active subscription. Depending on your Subscription Plan, you may also have access to additional content and other benefits.

- If you have an individual or Chairman's Lounge subscription, your subscription is for personal and non-commercial use only and must not be shared with any other person or third party.
- If you have a group or corporate subscription, your subscription must not be shared with any other person or third party, except your Nominated Users. You agree that these terms will apply to you and all Nominated Users under your subscription, and you will ensure that your Nominated Users are aware of and comply with these terms.
- If you would like to sign up for another type of subscription, please contact us at hello@rampart.news to discuss an alternative subscription plan.
- If you have an alternative subscription, these terms will apply except to the extent of any conflict between these terms and the terms of your alternative subscription plan, in which case the terms governing your alternative subscription plan will apply to the extent of that conflict.
- PAYMENTS AND CANCELLATION
- You will be charged the subscription fee in accordance with your Subscription Plan (Subscription Fee).
- By subscribing and providing details of your Payment Method, you authorise us and/or our third-party payment processor (which, for the time being, is Stripe Inc.) (Payment Processor) to charge your Payment Method the Subscription Fee at the time you subscribe, and at the beginning of each subsequent subscription period (which may be monthly or annually, if you have an individual subscription plan, or annually if you have a group or corporate or Chairman's Lounge subscription plan) until such time that your subscription is cancelled.
- All Subscription Fees are in Australian dollars.
- You acknowledge that there may be additional fees or charges (such as foreign transaction, currency conversion or card processing fees) depending on your selected Payment Method and you agree that you will be responsible for any such fees or charges.
- You must ensure that your Payment Method remains accurate and current at all times. If we and/or our Payment Processor are unable to process payment via your Payment Method or payment is unsuccessful (for example, due to insufficient funds, card expiry or other reasons), you may be asked to provide an updated payment method. If an updated payment method is not provided as requested, we may suspend your access to our Services and/or cancel your subscription.
- Your subscription will renew automatically at the end of each subscription period unless you cancel prior to the end of your subscription period. If you have a monthly subscription, you will not be sent any reminders prior to the start of the next subscription period. If you have an annual subscription, you will be sent a reminder before the start of the next subscription period.
- You may cancel your subscription at any time by logging into your Account, in which case your subscription will expire at the end of your current subscription period and you can continue accessing Rampart News Content until that time.
- We may also allow users to access some or all Rampart News Content for free from time to time, and you will not be entitled to any refund of your Subscription Fees if this occurs.
- We may change our Subscription Fees and prices at any time, and will give you at least 60 days' written notice prior to any pricing changes being implemented. However if you have a monthly subscription or annual subscription, your Subscription Fees will not change during your current subscription period. Therefore, if you do not agree with any changes to any fees or prices, you may cancel your subscription in accordance with the process set out above before your next subscription period commences.
- MANAGING YOUR SUBSCRIPTION
- You may manage and update your subscription, including your personal details, Subscription Plan, Payment Method and, if applicable, details of any Nominated Users, at any time by logging into your Account on the Website.
- If you have a group or corporate subscription, you will not be able to change the number of Nominated Users that are a part of your subscription during your current subscription period without our prior consent. Please contact us at hello@rampart.news to discuss any changes to the number of Nominated Users under your group or corporate subscription. Otherwise you can change the number of Nominated Users for your next subscription period.
- RAMPART NEWS CONTENT
- All Rampart News Content and content on the Website including all articles, graphics, illustrations, photographs, video, podcasts, music, logos, design, layout and downloads is owned by or licensed to Rampart.
- When you access any Rampart News Content through a subscription, we grant you a limited, non-exclusive, personal and non-transferable licence to download and view the Rampart News Content from the Website via any supported device for personal, non-commercial use only. You otherwise must not copy, reproduce, share, publish or modify any Rampart News Content for any purpose.
- By subscribing or using a subscription, you agree:
- to use and access the Rampart News Content in accordance with these terms and all applicable laws and regulations;
- to not use the Rampart News Content for any commercial purpose (including for any competitive advantage or to the competitive disadvantage to Rampart); and
- to not use the Services or any Rampart News Content for any illegal or fraudulent purpose.
- We reserve the right to terminate your subscription and access to Rampart News Content with immediate effect if you engage in any illegal or fraudulent use of our Services.
- DISCLAIMERS
- Rampart News Content is provided for your general information only. It is not intended to be any professional, business or financial advice and you should not rely upon any Rampart News Content as such. You should make your own enquiries and verify any information provided by Rampart and seek independent and specific advice prior to taking any actions.
- Rampart News Content is updated regularly on the Website and may change at any time without notice to you. We make no warranty or representation in relation to the availability of certain Rampart News Content on the Website at any time.
- The Website and Rampart News Content may also contain links to or display the content of third parties, including links to websites operated by other organisations and individuals. Third party content and websites are not under the control of Rampart. We do not endorse, approve or make any warranty or claim regarding any third party content or websites, or the products, services or information available on any third party website, or in respect of the owner or operator of a third party website or their conduct. If you use or rely upon any third party content or websites, you do so at your own risk.
- LIABILITY
The 'Australian Consumer Law' set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) provides consumers with a number of protections including guarantees that cannot be excluded, restricted, or modified. Nothing in these terms has the effect of excluding, restricting or modifying your rights under the Australian Consumer Law or any other applicable statutory rights that cannot be excluded, restricted or modified. However, where the Australian Consumer Law permits liability to be limited in respect of any services provided pursuant to these terms that are not of a kind ordinarily acquired for personal, domestic or household use or consumption, then we limit our liability in the manner and to the fullest extent permitted under the Australian Consumer Law to, at our option, the supply of the Rampart News Content and/or Services again or paying the cost of having them supplied again. To the extent permitted by law, neither Rampart nor you will be liable to the other for any indirect, special or consequential losses or damages of any nature (including loss of profits, revenue, goodwill, data or opportunity) however arising in connection with the supply or use of the Website, the Rampart News Content or our Services.
- GENERAL
- In these terms, unless a contrary intention is expressed:
- headings and italicised, highlighted or bold type do not affect the interpretation of these terms;
- the singular includes the plural and the plural includes the singular;
- other parts of speech and grammatical forms of a word or phrase defined in these terms will have a corresponding meaning; and
- the words 'include', 'including', 'for example', 'such as' or any form of those words or similar expressions do not limit what else is included and must be construed as if they are followed by the words 'without limitation'.
- We reserve the right to amend, revise or replace these terms from time to time provided that we give at least 60 days' advance notice of any material changes by contacting you via email or another nominated method, except where such changes are required due to factors outside of our reasonable control and it is not reasonably practicable for us to provide such notice. Amendments, revisions and replacements will be effective upon being published on the Website, unless a later effective date is specified. Therefore, if you do not accept any such changes to these terms: if you have a monthly subscription, you may cancel your subscription in accordance with the process set out above before your next subscription period commences; or if you have an annual subscription, please contact us at hello@rampart.news to discuss your options.
- If a provision in these terms is wholly or partly void, illegal or unenforceable in any relevant jurisdiction, that provision or part must, to that extent, be treated as deleted from these terms for the purposes of that jurisdiction. This does not affect the validity or enforceability of the remainder of the provision or any other provision of these terms.
- These terms are governed by and are to be construed under the laws in force in the state of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales and courts of appeal from them in respect of any proceedings arising out of or in connection with these terms.
